§ 4.24.080. Granting or denial of permit

  • If the council denies a permit, either in whole or in part, applicant shall thereupon be entitled to a hearing before the council with respect to such denial, provided applicant files a demand for such hearing within ten days after service upon him of notice of the order of denial by the council. Upon the filing by applicant, within the time above provided, of such demand for a hearing before the council, the council shall set a time and place for holding such hearing and cause notice thereof to be served upon applicant. The hearing hereinabove provided to be had shall be a condition precedent to any action in law or equity based upon the denial, either in whole or in part, of the council of the issuance of such permit; and the decision of the council upon such hearing shall be final. All permits issued hereunder shall be signed by the mayor and clerk and bear the seal of the city.
